The Fair Credit Reporting Act (FCRA) promotes accuracy, fairness and privacy of information in the files of the consumer reporting agency. A consumer has rights under the FCRA. A consumer must be told if information in their file has been used against them. A consumer has a right to know what is in their file. A consumer has the right to ask for their credit score. And most importantly you have the right to dispute inaccurate, incomplete, biased and untimely accounts.
The agency must reinvestigate unless the consumer files a frivolous dispute. Consumer reporting agencies must correct or delete inaccurate, incomplete or unverifiable information. Inaccurate and incomplete information must be removed or corrected within a reasonable time frame. Consumer reporting agencies may not report outdated negative information. A consumer may seek damages from violators. While states may enforce FCRA, many have their own consumer reporting laws. In some cases a consumer may have more rights under state law.
